Welcome to Hey Harvey ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Hey Harvey platform, including our website, mobile applications, and AI-powered legal information services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

3. Service Description

Hey Harvey provides:

• AI-powered legal information assistance in all 11 official South African languages
• Document upload and analysis capabilities
• Access to a directory of verified South African attorneys
• Case and matter management tools
• Legal information resources

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription and Payments

5.1 Subscription Plans

We offer the following subscription plans:

• Monthly: R88.00 per month
• 6 Months: R528.00 (R88/month)
• Yearly: R888.00 (R74/month, save R168)
• First 1000 Members Promo: R444.40 for the first year

5.2 Payment Processing

Payments are processed securely through PayFast and Ozow. All prices are in South African Rand (ZAR) and include VAT where applicable.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings.

5.4 Refunds

Due to the nature of digital services, refunds are generally not provided once a subscription period has begun. However, we may consider refund requests on a case-by-case basis within 7 days of purchase.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or to solicit illegal activities
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Upload malicious code or content
• Harass, abuse, or harm other users
• Use the Service to distribute spam or unsolicited communications
• Resell or redistribute the Service without authorization

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by Hey Harvey and are protected by South African and international copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any documents or content you upload to the Service. By uploading content, you grant us a limited license to process, store, and analyze such content solely for the purpose of providing the Service to you.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act (POPIA).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy, completeness, or usefulness of any information provided
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not responsible for any decisions made based on information obtained through the Service

10. Indemnification

You agree to indemnify and hold harmless Hey Harvey, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Consumer Protection

Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable consumer protection legislation in South Africa.
